Unauthorised copying, modification, distribution, reselling, or reverse-engineering of any part of the System is strictly prohibited and may result in legal action.

The CBC curriculum subject names and grading frameworks referenced in the System are sourced from the Kenya Institute of Curriculum Development (KICD) and remain the property of their respective owners.

SECTION 09

Limitation of Liability

The System is provided on an "as is" basis. While we strive for high availability and accuracy, we do not warrant that the System will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by Kenyan law, we shall not be liable for:

  • Loss of data due to network failures, device issues, or circumstances beyond our control.
  • Indirect, incidental, or consequential damages arising from use of the System.
  • Errors in results caused by incorrect data entered by Users.
  • Downtime during scheduled or emergency maintenance.

Continued use of the System after changes are posted constitutes your acceptance of the revised Terms.

Data Storage & Location

Your data is stored on Google Firebase (Firestore), a globally distributed database service operated by Google LLC. Data may be stored in servers located in the United States or other regions where Google operates data centres.

Firebase is compliant with major data protection frameworks. We have configured Firebase security rules to ensure that only authenticated Users can access their own school's data.

🔐
Data IsolationEach school's data is isolated by a unique School ID. No school can access another school's student records or results under any circumstances.
SECTION 16

Data Sharing

We do not sell, rent, or trade your personal data. We share data only with the following service providers who help us operate the System:

All providers are bound by their own privacy policies and applicable data protection laws.

SECTION 17

Your Rights

Under Kenya's Data Protection Act (2019), you have the right to:

  • Access — request a copy of the personal data we hold about you.
  • Rectification — ask us to correct inaccurate or incomplete data.
  • Erasure — request deletion of your data, subject to legal obligations.
  • Portability — request your School Data in a structured, machine-readable format (CSV export).
  • Objection — object to certain types of processing, such as analytics.

To exercise any of these rights, contact us via WhatsApp at 0704 518 130. We will respond within 14 days.

SECTION 18

Security Measures

We implement the following to protect your data:

  • Firebase Authentication with email/password for all user accounts.
  • Firestore security rules that enforce per-school data isolation.
  • HTTPS encryption for all data transmitted between your browser and our servers.
  • Server-side payment verification — we never expose payment API keys to the browser.
  • Regular review of access permissions and security configurations.

Despite these measures, no system can guarantee 100% security. We encourage you to use strong passwords and sign out after each session, especially on shared devices.

SECTION 19

Data Retention

We retain your data for as long as your account is active. If your subscription lapses:

  • Your data is preserved for 90 days after expiry, allowing you to renew and regain access.
  • After 90 days of inactivity (no renewal), we may delete your account data permanently.
  • You may request immediate deletion at any time by contacting us.

Anonymised, aggregated usage statistics (with no personal identifiers) may be retained indefinitely for service improvement purposes.

🍪

Cookie Policy

How the CBE Mark Sheet System uses browser storage to deliver a better experience.

SECTION 20

What Are Cookies & Local Storage?

Cookies are small text files stored on your device by your browser when you visit a website. The CBE Mark Sheet System uses a combination of browser cookies and localStorage (a similar web storage mechanism) to remember your preferences and keep you signed in.

We do not use third-party advertising cookies or tracking cookies. Our use of browser storage is strictly functional.

SECTION 21

ℹ️
No Advertising CookiesWe do not use Google Analytics, Facebook Pixel, or any third-party advertising or tracking scripts. The storage items above are all essential to the System's operation.
SECTION 22

Managing & Clearing Storage

You can clear all localStorage and sessionStorage data at any time through your browser settings:

  • Chrome / Edge: Settings → Privacy & Security → Clear browsing data → Cookies and other site data.
  • Firefox: Settings → Privacy & Security → Cookies and Site Data → Clear Data.
  • Safari (iOS/macOS): Settings → Safari → Advanced → Website Data → Remove All.

Note that clearing this data will sign you out and remove any cached preferences. It will not affect your school data stored in Firebase — all student records and results are safe in the cloud.

Because all storage items are strictly necessary for the System to function, we do not provide a cookie opt-out banner. Blocking these items may prevent the System from working correctly.

Questions or Concerns?

If you have any questions about these policies, wish to exercise your data rights, or need to report a concern, reach out to us directly.
